RULES AND REGULATIONS
Our Rules and Regulations are intended to ensure the safe enjoyment of the amenities, roads and our homes by owners, guests and lessees; protect the value of our community; and ensure fair and objective treatment for everyone living in or visiting our community.
No set of rules and regulations can possibly cover all potential issues, conflicts or disputes. Common sense application of the rules, plus City of Destin, Okaloosa County and Florida statutes must be relied on to make this an enjoyable place to live or visit.
GENERAL RULES
- No smoking or electronic cigarettes allowed in Club Destiny, on the pool deck, hot tub/spa, playground or Cabana Grill areas.
- No glass containers allowed on the pool deck, hot tub/spa, playground or the Cabana Grill areas.
- No pets are allowed in Club Destiny, pool deck, hot tub/spa, playground or Cabana Grill areas.
- Do not enter Club Destiny while wet or wearing a wet bathing suit. Access the restrooms via the entry on the west side of the club.
- All guests must wear Club Destiny wristbands to access all the amenities. Club Destiny Staff reserves the right to deny access to anyone without wristbands. If you rent your home, your tenants are required to have wristbands. Property Managers may pick up bands with written or emailed authorization from owners or you may purchase them. Wristbands cost $20/band per week. Effective January 1, 2018, homeowners will receive 8 free wristbands. Owners may also purchase annual wristbands at a cost of $75 per wristband (20 maximum).
- A noise curfew begins at 10 pm to 7 am on Sunday through Thursday and 11 pm to 7 am on Friday, Saturday and the evening preceding a federal holiday. Outdoor speakers and parties must reduce the volume at that time. Loud noise or music that becomes a nuisance at any time is not allowed.
- Anyone causing any damage to DE property will be required to reimburse the Destiny East Owner’s Association (DEOA) for the replacement or repair of the damaged property and may be barred from using all amenities.
- Club Destiny privileges can be revoked if rules are ignored.
- Owners are responsible for the actions of their guests, invitees and lessees.
- Owners are required to notify their tenants and rental companies of the DE Rules and Regulations.
- The police will be called anytime anyone is found to be intoxicated and acting inappropriately, using illicit drugs, drinking underage or engaging in lewd behavior.
FITNESS CENTER
- Gym attire is required including tennis shoes. No bathing suits.
- No food or alcoholic beverages allowed in the Fitness Center.
- Equipment must be returned to its original locations and wiped down after use and before exiting the Fitness Center. Turn off lights and televisions upon exiting.
- Children under 14 years of age are not allowed in the Fitness Center at any time.
- An adult must supervise children under age 12.
- Children under age 3 must wear swim diapers while in the pool.
- No jumping or diving from, playing in or hanging on the fountain.
- Pets are not allowed in the pool, on the pool deck, clubhouse or playground at any time.
- Shower before entering pool. No wetsuits allowed in the pool.
- No lifeguard is on duty. DEOA will not be liable for any personal injuries or accidents. No diving, running or horseplay in or around the pool area.
- All trash must be bagged and thrown away in the containers outside Club Destiny.
- No climbing on fence around pool or tennis courts.
- No swimming during thunderstorms.
POOL/HOT TUB/SPA RULES
- No one under age 12 is allowed in the hot tub/spa.
- Shower before entering hot tub/spa. No wetsuits allowed in the hot tub/spa.
- Pregnant women, small children, people with health problems & people using narcotics or other drugs that cause drowsiness should not use hot tub/spa without first consulting a doctor.
PLAYGROUND RULES
- An adult must supervise children under age 6.
- Rinse sand off before entering pool.
CABANA/GRILL RULES
- Use is first-come, first-served.
- Grill and grilling area must be cleaned after use.
- Turn off gas when finished cooking.
TENNIS COURT/PICKLEBALL RULES
- Limit play when others are waiting to 1-½ hours for doubles and 1 hour for singles.
- Roller-blades, roller-skates and skateboards are prohibited on tennis courts.
- Only tennis, pickleball and basketball are allowed on courts. No soccer volleyball or kickball is allowed at any time.
- No dark soled-shoes are allowed.
JMAX THEATER RULES
- The theater is available on a first-come, first-served basis. Reservations are required to watch a movie. Sign up at the Clubhouse.
- The theater is only open during club hours.
- Snacks and drinks are allowed in the theater, but guests must clean up after themselves.
- Only Club Destiny personnel are permitted to adjust any theater equipment.
CLUBHOUSE AND POOL RENTAL
- Only an owner may make Club Destiny reservations. The owner must pay all fees and deposits in advance. After an inspection of the facility and return of any DE property, the damage deposit will be refunded in a timely fashion.
- DE OWNER MUST BE PRESENT AT ALL TIMES DURING EVENT. IF THE OWNER IS NOT PRESENT THE DEPOSIT WILL BE FORFEITED.
- Club Destiny may be rented for social functions, parties and meetings. Club Destiny may not be used for political events or those generating financial income.
- Reserving the clubhouse does not reserve the common areas - pool, pool deck, hot tub/spa area. These common areas will remain open to all owners and their guests.
- All events in Club Destiny must end by 12 am.
- All personal, catering and rental items must be removed from Club Destiny by 9 am the following day.
- All areas must be returned to their pre-party condition prior to the owner leaving the facility. Any personal/catering/rental equipment must be moved inside if it is to be left overnight.
- All trash must be bagged and thrown away in the containers outside Club Destiny.
- All dishes, utensils, or other items that are the property of the DE must be left in an orderly manner in the kitchen/bar area.
- No confetti decoration of any kind shall be used.
- A Club Attendant must be hired for parties of 26 or more. The charge for an attendant is $25 per hour and attendant must be present for the duration of the event. This is payable at time of reservation.
- Owners will provide guest(s) with gate codes and instructions.
- Owners will be responsible for placing parking signs on street and lot.
- Owners must make any poolside event reservations. All fees and deposits must be paid in advance. Poolside event reservations are required for all parties of 10 or more people. There is a $75 damage/cleaning deposit required. There is a limit of two parties at a time with the maximum number of attendees per party of 25. Events must end by 10 pm.
- Poolside events are scheduled on a first-come, first-served basis and may be made in advance. No event or party will have exclusive use of the poolside area. Any rules broken by you and/or your guests will result in you and your guests being asked to leave and your deposit forfeited.
VEHICLES
- The speed limit for all vehicles is 20 mph.
- All vehicles must follow posted traffic signs.
- Only properly licensed and insured vehicles are allowed on DE roads. No go-carts, minibikes, motorized skateboards or other unlicensed or uninsured vehicles are allowed, with the exception of golf carts registered with DEOA.
- A numbered DE sticker applied to the upper, passenger side windshield, must identify owner’s vehicles. Stickers may be obtained from the Club Destiny.
- Golf carts must be registered with the DEOA and must have a numbered sticker applied to the passenger side windshield, front of cart. If there is not a sticker on your golf cart, you may be issued a citation and a fine imposed. Proof of registration should be kept in rental carts. Register golf carts at Club Destiny.
- Only licensed drivers are allowed to operate a golf cart, within the community of DE, whether it’s street legal or a regular golf cart.
- Golf carts are not allowed on the sidewalks, the Exercise Trail or off paved roads.
- Rules of the road apply when golf carts are driven through the subdivision. Swerving, overloading the cart with passengers, driving carelessly, recklessly, driving too fast for conditions, being a nuisance, being inattentive, or horseplay on or with a golf cart is prohibited.
- Golf carts may be driven at night only if they have proper working headlights and taillights.
- Golf carts must be properly licensed and operated by a legally licensed operator to be driven outside gates of DE and are subject to Florida statutes.
- DE staff may issue a violation citation to an individual that fails to operate a golf cart in a safe manner based on written witness accounts, written complaints, accidents or violations.
PARKING
- No parking on the street or in the Club Destiny parking lot from 1 am to 5 am.
- No parking of any vehicle is allowed on the grass area between the sidewalk and the road or any unpaved surfaces at any time.
- Parking over the sidewalk in driveways is allowed only from 5 pm to 10 am the following morning. During all other hours, the sidewalk area of the driveway must be unobstructed.
- No jet skis, boats, trailers motor homes, inoperable or commercial vehicles are to be kept on the property overnight unless parked in a closed garage. Overnight is defined as 7:00 p.m.to 7:00 a.m.
- Motorcycles and licensed scooters are allowed for ingress and egress only.
- Owners’ vehicles bearing a company logo or message, which is confined to the front doors are allowed to park in driveways overnight if registered with the DEOA. Application to the ARB, with photos of the vehicle and logo or message, is required to obtain registration with the DEOA.
- Vehicles wrapped in commercial messaging may not be parked overnight unless parked out of sight in a garage.
- Only properly registered and licensed vehicles and non-street legal golf carts registered with the DEOA are permitted to park on driveways overnight.
- Any vehicle that is trespassing and/or violates the parking regulations is subject to being towed without notice at the owner’s expense. This includes overnight parking in the Club Destiny parking lot.
- Construction trailers or dumpsters for any project may be parked in driveways during construction only with Architectural Review Board (ARB) approval.
- Moving trucks or trailers may be parked overnight for one night with a permit available at Club Destiny.
PETS
- All pets are required to be on a leash regardless of size or obedience training when not in an enclosed area.
- No pet is allowed to run at large and must be kept in an enclosed area that is clean and reasonably free of refuse and waste.
- Pet waste must be immediately picked up from Common Areas and other owner’s lawns and disposed of properly.
- Owners of animals that are repeatedly a nuisance to neighbors may be subject to fines.
GARBAGE
- Garbage pickups are Tuesday and Friday. Garbage must be placed at the curb after 5 pm the day preceding pickup and the empty container removed by midnight the day of collection.
- All trash must be in trash containers for pickup.
- Recycling waste is picked up on Tuesdays and must be placed at the curb after 5 pm on the day preceding pickup and the empty container removed by midnight the day of collection.
- Garbage containers must be placed out of view from the street after collection.
- If garbage/trash containers are kept outside, the containers must be kept in a side or rear yard not readily visible from the street or public areas and located where not to negatively impact any neighbor.
- Pickup for yard waste is Friday and must be bagged or bundled and placed at the curb.
SIGNAGE RULES
- The community has restrictions on the allowable signage for short-term rentals, addresses, decorative name or address plaques and construction signs. All decorative signs require approval by the ARB. Please consult the Design Code for details or contact DEOA management.
- Political signs may be placed in front yards up to two weeks before an election and must be removed one week after the election. Only one sign for each ballot issue or candidate may be displayed. Signs my not exceed 18”X24” in size.
- The DEOA has the authority to remove and retain, without notice, any and all signage that is prohibited, non-conforming to standard specifications or not having prior approval of the ARB.
FOUR PRONG LAKE RESTRICTIONS
- No motorized boats are allowed on the lake.
- No dumping of trash or garbage in the lake.
- All fish caught from the lake must be released safely to the lake.
- No trespassing on private property for fishing.
FINES
- Fines may be assessed for any violation of any of DE’s Rules and Regulations and are subject to Florida maximum of $100 per occurrence up to a maximum of $1,000 for consecutive fines of the same infraction. Fines that are health and safety related are generally higher so as to protect owners and guests from undue harm.
